Originally conceived in 1995, the Data Protection Directive, or Directive 95/46/EC, is about the protection of individuals with regard to the processing of personal data and on the free movement of such data. This directive regulates the processing of personal data within the European Union. It is an important component of EU privacy and human rights law.
The principles governing the OECD’s recommendations for protection of personal data include: data should only be used for stated purpose, obtaining consent for disclosure, and ensuring security of data collected.
EU directives are addressed to all member states that must transpose the directive into internal law. Today, all EU member states have enacted their own data protection legislation. For example:
TITUS Classification Solutions can help agencies meet the requirements of their member state data protection laws, and ultimately comply with the EU Data Protection Directive. TITUS solutions allow organizations to classify and mark personal data in email and documents, making it easier to decide how to handle information, and comply with data protection legislation.
EU member state protection legislations all spawn from the EU directive, but are all unique. The TITUS classification solutions can be easily customized to labelling, marking or classification standards used by any member state. TITUS Message Classification and Classification for Microsoft Office are easily configurable, and can be used to help comply with your protections legislations in a number of ways. TITUS solutions have several features that can help organizations build compliance for personal data:
| Classification Selector: | Upon sending personal information, the data handler would be asked to classify the sensitivity of this information. This would determine the lifecycle of that piece of information (ie: How the information is handled and who can access the information). |
| Label Marker: | Upon sending personal information, the data handler would be asked to classify the sensitivity of this information. This would add visual labels to the information being sent, promoting the awareness of the sensitivity of the information for the recipient(s). |
| Metadata Generator: | TITUS classification solutions embed metadata into the information to further prevent abuse. This can be leveraged by downstream technologies such as DLP, and perimeter security solutions, safeguarding the information from malicious use. |
| Policy Verifier: | Upon sending personal information, data handlers would be warned that the data subject must be given notice, must give their consent, and must also be informed as to who is collecting their data. The user would then be provided remediation actions. |
| Logging and Reporting: | The data subject could be sent a report showing the lifecycle of their personal information, including details about recipients, date, time, classification actions and policy violations. |
